Liberty is death for old pop group

[...] Three members of the former Spandau Ballet group lost a legal battle over the name yesterday. Tony Hadley, John Keeble and Steve Norman applied to register it as a trademark excluding two other former members. The High Court ruled that the trademark belonged to the band’s trading company, Marbelow Ltd, controlled by one of the two excluded former members, Gary Kemp. The court also granted an injunction to ensure that Hadley, Keeble and Norman use the term ex-Spandau Ballet only in connection with live appearances and to ensure that the name Spandau Ballet is not used to give the impression that the group is appearing.
An article (Return of the boys named sue, Times 2, January 21) about the above case incorrectly reported that the writ had been served by Martin Kemp, an ex-member of the band. It was, in fact, Marbelow, the band’s trading company, which issued the writ, and the action was for alleged breach of fiduciary duty, not over copyright issues.
